Daisetta Rolloff controversy

 

The issue of a roll-off dumpster in the City of Daisetta caused a bit of a controversy in that city over the past few days.  We reported several weeks ago, two family members died in a house fire. The home of the Ener family on Pine St. in Daisetta was destroyed by flames in mid-December and two family members perished. On Tuesday, a company donated the loan of a roll-off dumpster to allow Good Samaritan neighbors to begin the clean up process.  However, City of Daisetta officials had the container removed, citing an exclusive contract with the Piney Woods Waste Management Company to collect trash and provide roll-off containers in that city. A press release from Daisetta officials said once it was determined the container was to help the stricken family, they reached out to Piney Woods company who agreed they had no problem with the competitor’s container being used at the destroyed home. It should be noted, legal experts we reached out to, at least one of which works as an attorney for a governmental agency, said the City of Daisetta did not have the authority to bind citizens to a contract made with the city, calling it a government enforced monopoly.  While the contract with Piney Woods does give that company exclusive rights to trash collection in the city of Daisetta it does not, we were told, give them the right to all of the private business citizens of Daisetta may wish to conduct with another similar company.  We asked, by email, for a response from the City of Daisetta but have not yet heard back from them.  It should be noted that our email was sent late in the day Wednesday, and Daisetta City officials may not have had time to respond prior to this report.
