Ruling in McCarty’s Appeal: The Ninth District Court of Appeals in Beaumont has ordered a new criminal trial for Mike McCarty based on faulty jury instructions. We reported Mr. McCarty was serving as Liberty County Pct. 1 Commissioner back in April 2017 when he was convicted on two Class B misdemeanor charges of Abuse of Official Capacity. In Wednesday’s ruling, the court of appeals said there was enough evidence in this case to legally support the jury’s findings of guilt. However, the judges’ decision also said the failure to submit accomplice-witness jury instructions related to two people who testified resulted in harm calculated to injure the rights of the defendant. With that statement, the Ninth Court of Appeals reversed the judgments against Mike McCarty and remanded the criminal case for a new trial on the merits. It’s important to note that Mike McCarty is still removed from office based on a separate civil case’s temporary order. A change in that decision would require a trial or dismissal of the civil case.

Early Voting: Don’t forget - tomorrow is the final day of the early voting period for the November 6th General Election. In Liberty County, early voter turnout continues to be impressive. As of the close of polls Tuesday, 11,135 people had voted early in Liberty County. Early voting opportunities continue for today and tomorrow from 7 a.m. to 7 p.m. Early voting is at any of four locations: the Jack Hartel Community Building in Liberty; Cleveland Civic Center; the Dayton Community Center and Hardin City Hall. A reminder, Election Day voting on Tuesday will be by designated precinct. For voting information, call the Liberty County Clerk’s Office at 936-336-4670.

Volleyball Playoffs: The Hardin, Tarkington and Barbers Hill volleyball teams have all advanced to the Area round of the state playoffs. Tarkington faces Brazosport today at 7 p.m. at neutral site - LaPorte High School. The Hardin girls take on New Waverly tomorrow at 5:30 p.m. in the Crosby High School gym. Also tomorrow in the Area around of the volleyball playoffs, Barbers Hill meets Manvel at 5:30 p.m. at LaPorte High School.
